Welcome to TAYLAAY a digital marketplace that enables individuals to list, discover, and book vehicles for short-term use across the Caribbean and other approved regions globally.

These Terms of Service (the “Terms”) constitute a legally binding agreement between you and Taylaay, governing your access to and use of the Taylaay website, mobile application, and associated services (collectively, the “Platform”). Please read these Terms carefully.

By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any supplemental terms or policies referenced herein.

 

1. Definitions

  • "Platform" refers to Taylaay’s website, mobile app, and any services offered therein.
  • "User" means any individual or legal entity who accesses or uses the Platform.
  • "Host" means a User who lists a Vehicle for sharing.
  • "Guest" means a User who books a Vehicle from a Host.
  • "Vehicle" means a privately-owned road-legal motor vehicle listed on the Platform.
  • "Booking" means a formal agreement between a Host and Guest facilitated through the Platform.
  • "Services" include any functionality provided by Taylaay in support of car sharing, including payments, identity verification, and insurance facilitation.

 

2. Eligibility and Account Creation

To use the Platform:

  • You must be at least 21 years old or the minimum legal driving age in the jurisdiction where the Vehicle is located.
  • Guests must possess a valid, government-issued driver’s license, acceptable in the jurisdiction of rental.
  • Hosts must be the registered and legal owner of the Vehicle or have verifiable authority to list it.
  • All Users must complete Taylaay’s account verification process, which may include identity checks, driving record review, and insurance validation.

Taylaay reserves the right to deny, suspend, or terminate accounts at its sole discretion.

 

3. How the Platform Works

Taylaay provides a digital venue where:

  • Hosts list Vehicles available for booking;
  • Guests search for and book Vehicles based on availability, location, and price;
  • Taylaay facilitates secure payment processing, communication, and optional insurance or protection products.

We are not a rental car company, insurer, or agent for any User. Taylaay is not a party to any agreement between Users.

 

4. Guest Obligations

Guests agree to:

  • Use Vehicles only for personal, lawful, non-commercial purposes;
  • Operate Vehicles in compliance with local traffic and safety laws;
  • Accept full responsibility for fines, tolls, damages, or traffic violations during the booking;
  • Return the Vehicle on time and in the condition received, excluding normal wear and tear;
  • Immediately report accidents, damage, or theft to [App Name] and the Host.

Failure to comply may result in additional charges, claims, or permanent account suspension.

 

5. Host Obligations

Hosts agree to:

  • List only Vehicles that are insured, registered, and roadworthy;
  • Maintain accurate Vehicle descriptions, photos, and availability;
  • Disclose any mechanical issues or safety concerns;
  • Provide clean, fueled, and legally compliant Vehicles;
  • Respond promptly to Guest inquiries and resolve post-trip claims in good faith.

Hosts are responsible for understanding their insurance obligations in their local jurisdiction and for verifying the validity of the Guest’s license and condition of the Vehicle upon return.

 

6. Payments, Fees, and Taxes

All payments are processed through the Platform using secure, third-party processors.

  • Taylaay deducts a commission or host fee from each completed transaction;
  • Guests may incur additional charges for late returns, damages, excessive cleaning, or fuel discrepancies;
  • Hosts may be subject to penalties for cancellations or failure to provide a booked Vehicle;
  • Users are responsible for reporting and paying any applicable taxes (e.g., VAT, GST, income tax) related to their use of the Platform.

7. Insurance, Protection, and Claims

Taylaay may offer optional protection plans for both Hosts and Guests, which may include coverage for physical damage, theft, and liability. Availability and terms vary by country and jurisdiction.

  • Protection plans do not replace the Host’s obligation to carry mandatory insurance as required by law;
  • Claims must be reported within 24 hours of the incident with supporting evidence (photos, police reports, etc.);
  • Taylaay is not an insurer and does not guarantee the outcome of any claim.

Users must fully cooperate in any investigation, including providing statements, documents, or access to Vehicles.

 

8. Cancellations and Refunds

Cancellation policies are displayed at the time of Booking and may vary by Host.

  • Guests who cancel within the allowed window may receive a full or partial refund;
  • Cancellations made outside the policy may result in forfeiture of payment;
  • Hosts who cancel without cause may be penalized with fees, account restrictions, or removal from the Platform.

9. Prohibited Activities

Users are strictly prohibited from:

  • Using the Platform or any Vehicle for illegal activities, commercial transport, or unlicensed ridesharing;
  • Circumventing Platform policies (e.g., conducting off-platform bookings);
  • Tampering with Vehicles or using Vehicles in unsafe conditions;
  • Harassing, abusing, or discriminating against other Users;
  • Providing false information, including fraudulent documents or identification.

Violation may result in immediate account suspension, legal action, and reporting to authorities.

 

10. Disclaimers and Limitation of Liability

To the fullest extent permitted by law:

  • Taylaay does not guarantee the condition, safety, legality, or performance of any Vehicle;
  • Taylaay is not liable for indirect, incidental, punitive, or consequential damages arising out of or in connection with use of the Platform;
  • Our total liability under these Terms shall not exceed the total amount paid by the User in the prior 90 days before the claim.

Your use of the Platform is at your sole risk.



11. Indemnification

You agree to defend, indemnify, and hold harmless Taylaay and its officers, directors, employees, agents, licensors, and affiliates from and against all claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Platform;
  • Your breach of these Terms;
  • Any violations of local law or rights of any third party.

 

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Trinidad and Tobago

Dispute Resolution:

In the event of a dispute:

  1. The parties agree to attempt resolution through good-faith negotiation;
  2. If unresolved, disputes shall be submitted to binding arbitration under the Primary Jurisdiction of Trinidad and Tobago
  3. Either party may seek equitable relief in a court of competent jurisdiction for matters involving immediate risk of harm.

 

13. Modifications

Taylaay reserves the right to modify these Terms at any time. Changes are effective upon posting. You are responsible for reviewing updates. Continued use of the Platform constitutes acceptance of the modified Terms.



14. Account Termination

We may suspend or terminate your access:

  • For violations of these Terms;
  • At our discretion in the event of fraud, abuse, or legal requirement;
  • Without prior notice if immediate action is necessary to protect Users or the Platform.

Upon termination, all fees owed remain due.
